Terms of service

Welcome to URBANEO.CLUB, home of Urbaneo Style family-friendly street-art tees and hoodies. These Terms of Service ("Terms") apply when you use urbaneo.club or buy from us. "We", "us" and "our" means Urbaneo Style (URBANEO.CLUB), New Zealand. By using our store or placing an order, you agree to these Terms. Please also read our Privacy Policy, Shipping Policy and Refund Policy, which form part of these Terms.

Your consumer rights come first. Nothing in these Terms excludes, restricts or changes any rights you have under consumer laws that can't be excluded, including the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986, the Australian Consumer Law, the UK Consumer Rights Act 2015 and Consumer Contracts Regulations 2013, EU and German consumer law, and consumer laws in the United States, Canada and Mexico.

1. Our store

Our store is hosted on Shopify. Our products are made to order by third-party print partners and shipped directly to you. You must be at least 18, or the age of majority where you live, to place an order, or have a parent's or guardian's permission.

2. Orders and contract

When you place an order, you're making an offer to buy. We'll email you an order confirmation. A contract is formed when we confirm your order (for example by order confirmation or shipping email). We may decline or cancel an order (with a full refund) if a product is unavailable, we suspect fraud, or there's an obvious pricing or listing error.

3. Prices, payment and pricing errors

Prices are shown in your local currency where available, and are charged in NZD or the currency shown at checkout. Your bank may apply conversion fees. Taxes and shipping are shown at checkout. Import duties may apply as explained in our Shipping Policy.

Bundle discounts: buy 2 tees or hoodies and save 10%; buy 3 or more and save 15%. Discounts don't stack with each other, and we may change or end promotions at any time (this won't affect orders already placed).

We work hard to get prices right, but mistakes happen. If an item is listed at an obviously incorrect price, we'll contact you before shipping and give you the choice to pay the correct price or cancel for a full refund.

4. Product colour, sizing and print variance

Each item is printed individually. Small differences are a normal part of the print-on-demand process and aren't defects:

colours may look slightly different on fabric compared with your screen;
print placement can vary slightly (about ±2.5 cm);
garment colours and dye lots from the blank manufacturers can vary slightly.

Please check the size guide on each product page before ordering. Items that are faulty, misprinted or not as described are covered by our Refund Policy and your legal rights.

5. Intellectual property

All Urbaneo Style designs, artwork, logos, text, photos and other content on urbaneo.club are owned by or licensed to us and are protected by copyright and trademark laws. Buying a product gives you ownership of that physical item. It doesn't give you any right to copy, reproduce, resell prints of, or commercially use our designs. Please don't copy our designs or content without our written permission. If you think something on our store infringes your rights, email hello@urbaneo.club.

6. Acceptable use

When using our store, please don't:

break any law or infringe anyone's rights;
place fraudulent orders or use someone else's payment details;
attempt to hack, disrupt, scrape or overload the site, or introduce malware;
post reviews or content that is false, offensive, hateful, or infringes others' rights.

We may remove content and suspend access for anyone who breaks these rules. If you send us reviews, photos or ideas, you give us a non-exclusive, royalty-free licence to use them in connection with our store (we'll credit you where appropriate). If you send ideas or suggestions, we're free to use them without obligation.

7. Shipping, returns and cancellations

See our Shipping Policy and Refund Policy. Delivery times are estimates.

8. Third-party services

Our store relies on third parties (such as Shopify, payment processors, print providers and carriers). Links to third-party websites are provided for convenience. We're not responsible for their content or practices.

9. Our liability

To the extent permitted by law:

our store is provided "as is", and we don't guarantee it will always be available or error-free;
we aren't liable for indirect or consequential losses (such as loss of profits or opportunity) that weren't reasonably foreseeable;
our total liability to you for any order is limited to the amount you paid for that order.

These limits don't apply where the law doesn't allow them, including liability for death or personal injury caused by negligence, fraud, or your non-excludable rights under consumer guarantee laws. If you're a consumer in the UK or EU, we're responsible for foreseeable loss caused by our breach of these Terms or our failure to use reasonable care. If you're a consumer in Australia, our liability under the Australian Consumer Law is not limited except as that law permits. If you're buying for business purposes, the NZ Consumer Guarantees Act doesn't apply (as permitted by section 43 of that Act), to the extent allowed by law.

10. Governing law and disputes

These Terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction. However, if you're a consumer living in another country, you keep the protection of the mandatory consumer laws of your country, and you can bring proceedings in your local courts where the law allows. If you have a problem, please contact us first. We'll do our best to resolve it quickly and fairly. EU consumers can also use their national consumer dispute resolution bodies. We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle), unless required by law.
